These Terms & Conditions apply to your use of the Comfy Kids Swim website and to purchases made through our online store.

Comfy Kids Swim is a trading name of Kathryn Castle, a sole trader in England.

By placing an order with us, you agree to these Terms & Conditions. Nothing in these terms affects your statutory rights as a consumer.

1. About our store

Comfy Kids Swim is an online retailer of children’s swimming products, including swimwear, goggles, swimming aids, towels, changing ponchos and related products.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products to you. Your contract for the purchase of products is with Comfy Kids Swim, not Shopify.

2. Products and product information

We take reasonable care to ensure that product descriptions, photographs, sizes, prices and other information on our website are accurate.

Colours and appearance may vary slightly depending on your screen or device. Where sizing information is supplied by a manufacturer or brand, we provide it to help you choose the most appropriate size.

All products are subject to availability. We may change or discontinue products without notice.

Nothing in these terms affects your legal rights where goods are faulty, not as described, or otherwise fail to meet the standards required by UK consumer law.

3. Prices and payment

Prices are shown in pounds sterling (£) unless stated otherwise.

Any applicable delivery charges will be shown before you complete your purchase.

We may change our prices from time to time, but changes will not affect orders that we have already accepted.

Payment must be made using one of the payment methods available at checkout.

If an obvious pricing or product information error occurs, we may contact you before accepting or fulfilling the order. If we are unable to fulfil an order that has already been paid for, we will refund the appropriate amount.

4. Orders

When you place an order, you are offering to purchase the products in your basket.

After placing your order, you will receive an electronic acknowledgement. Acceptance of your order takes place when we confirm that your order has been accepted or dispatched, at which point a contract is formed between you and Comfy Kids Swim.

We may occasionally be unable to accept an order, for example because a product is unavailable, there is an error in its price or description, or we are unable to authorise your payment.

If we cannot accept an order after payment has been taken, we will refund the relevant amount.

5. Delivery

Available delivery options and any applicable charges will be displayed at checkout.

Any delivery dates or times we provide are estimates unless we expressly agree otherwise.

We are responsible for the goods until they are delivered to you or to a person you have identified to receive them, except where you independently arrange delivery with a carrier that we did not offer.

If your order is significantly delayed, lost or arrives damaged, please contact us at info@comfykidsswim.com so that we can help.

6. Returns, cancellations and refunds

In addition to your statutory rights, Comfy Kids Swim offers a 30-day returns policy for eligible items.

If you change your mind or order the wrong size, you are responsible for the cost of returning the item to us.

Items should be returned unworn, unused and unwashed, with tags attached and, where applicable, in their original packaging. Any hygiene strips, protective liners or seals supplied with an item should remain intact.

Different rules apply where an item is faulty, damaged, incorrect or not as described. Where appropriate, we will cover reasonable return costs for such items.

UK consumers also have statutory cancellation rights for most online purchases. These rights are separate from our voluntary 30-day returns policy and are not restricted by these Terms & Conditions.

7. Your consumer rights

Products supplied by us must meet the standards required by applicable UK consumer law, including being as described, of satisfactory quality and fit for purpose where applicable.

Nothing in these Terms & Conditions excludes or limits any rights or remedies that cannot lawfully be excluded or limited.

8. Swim and water-safety products

Parents and carers are responsible for selecting products appropriate for their child’s age, size, ability and intended activity and for following the manufacturer’s instructions, warnings and guidance supplied with a product.

Swimming aids and buoyancy products are not a substitute for appropriate adult supervision unless expressly stated otherwise by the product manufacturer. Children should be appropriately supervised in and around water.

9. Intellectual property

The content of this website, including our own text, branding, graphics and website design, is owned by or licensed to Comfy Kids Swim unless otherwise stated.

Product names, trademarks, photographs and other material belonging to the brands we stock remain the property of their respective owners or licensors.

You may use our website for personal, non-commercial purposes. You must not reproduce or commercially exploit our website content without permission from the relevant rights holder.

10. Third-party services and links

Our website may use or link to services provided by third parties, including payment providers, delivery services and Shopify.

Where you follow a link to a third-party website, that website will have its own terms and policies. We are not responsible for third-party websites that we do not operate.

11. Privacy

We handle personal information in accordance with our Privacy Policy.

Shopify and other service providers may process information on our behalf where necessary to operate our online store, process payments, fulfil orders and provide related services.

12. Our responsibility to you

We do not exclude or limit our liability where doing so would be unlawful.

This includes liability that cannot legally be excluded or restricted and does not affect your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from purchases made wholly or mainly for commercial purposes, to the extent permitted by law.

13. Events outside our control

We will not be responsible for delays or failures caused by events outside our reasonable control. If such an event materially affects your order, we will take reasonable steps to minimise the impact and will contact you where appropriate.

Your statutory rights remain unaffected.

14. Changes to these terms

We may update these Terms & Conditions from time to time, for example to reflect changes to our business, website or applicable law.

The terms applying to an order will normally be those in force when that order is placed.

15. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the UK, you may also benefit from mandatory protections and rights to bring proceedings available under the law applicable to you.
